1. Acceptance of Terms

By accessing or using moderntvstand.com (the “Site”), you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you don't agree, please don't use the Site.

2. What We Are (and Aren't)

Modern TV Stand is an editorial catalog. We curate TV stands and link to the retailers and manufacturers that sell them. We do not sell, ship, warehouse, warrant, or service any product listed on the Site. Every purchase is a transaction between you and the third-party retailer, governed by that retailer's terms, policies, and warranties.

3. Use of the Site

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms.
• Scrape, crawl, or harvest content or data using automated means without our prior written consent.
• Interfere with or disrupt the Site, its servers, or networks connected to it.
• Attempt to gain unauthorized access to any portion of the Site.
• Reproduce, duplicate, copy, sell, or resell any portion of the Site.

4. Intellectual Property

All Site content — text, editorial reviews, layouts, and the Modern TV Stand name and logo — is owned by us or our licensors and protected by copyright, trademark, and other laws. Product images and specifications belong to their respective manufacturers or retailers and are used to identify and describe products. You may share links to individual pages; you may not republish our editorial content without written permission.

5. Third-Party Links and Retailers

The Site contains affiliate links to third-party websites. We don't control those sites and are not responsible for their content, products, prices, availability, shipping, returns, warranties, or privacy practices. Prices and availability shown on our Site may be out of date at any given moment — always confirm on the retailer's page before purchasing.

6. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. We do not warrant that product information, pricing, availability, or images on the Site are accurate, complete, or current.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MODERN TV STAND WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SITE OR ANY PRODUCT PURCHASED FROM A LINKED RETAILER. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE IS LIMITED TO ONE HUNDRED U.S. DOLLARS ($100).

8. Indemnification

You agree to indemnify and hold harmless Modern TV Stand and its operators from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising from your use of the Site or violation of these Terms.

9. Binding Arbitration and Class Action Waiver

Please read this section carefully — it affects your legal rights.

Agreement to arbitrate. You and Modern TV Stand agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or your use of the Site (a “Dispute”) will be resolved exclusively through final and binding individual arbitration, rather than in court, except that (a) you may assert claims in small-claims court if your claims qualify and remain in that court, and (b) either party may seek injunctive or equitable relief in court to protect intellectual property rights.

Arbitration procedure. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in English, by a single arbitrator, and — unless the parties agree otherwise — by written submissions and telephone or video conference. The arbitrator's decision will be final and enforceable in any court of competent jurisdiction. The Federal Arbitration Act governs the interpretation and enforcement of this section.

Class action waiver. You and Modern TV Stand agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If this class action waiver is found to be unenforceable, then the entirety of this Section 9 will be null and void, but the rest of these Terms will remain in effect.

30-day opt-out. You may opt out of this arbitration agreement by emailing hello@moderntvstand.com within 30 days of first accepting these Terms, with the subject line “Arbitration Opt-Out” and including your full name and the email address you use with the Site. Opting out will not affect any other provision of these Terms.

No jury trial. If for any reason a Dispute proceeds in court rather than in arbitration, you and Modern TV Stand each waive any right to a jury trial.

10. Governing Law

These Terms are governed by the laws of the State of California and applicable U.S. federal law, without regard to conflict-of-law principles. Subject to Section 9, any dispute not subject to arbitration will be resolved exclusively in the state or federal courts located in California, and you consent to their jurisdiction.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we'll change the “Last updated” date above. Your continued use of the Site after changes take effect means you accept them.
